TERMS OF SERVICES

1. Agreement to Terms

By accessing or using my services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you may not use my services.

2. Services Description

Glacier Web Dev provides web design, development, and maintenance services for businesses and individuals. Services may include custom website design, responsive development, hosting setup, CMS configuration, and ongoing support.

3. Project Scope and Timeline

All projects are governed by a project estimate or Statement of Work (SOW). The following apply to all projects:

• Project timelines are estimates and depend on client responsiveness.
• Delays caused by missing materials will extend delivery timelines.
• Changes to the agreed scope require approval and may incur additional costs.
• I may pause or discontinue a project if the client becomes unresponsive for 30 days.

4. Payment Terms

All payments must follow the terms outlined in the invoice or project agreement:

• Deposit: 50% upfront to begin work.
• Final Payment: Required before website launch or file delivery.
• Late Payments: A 5% fee may apply every 15 days after the due date.
• Refunds: Deposits are non-refundable once work has started.

5. Client Responsibilities

The client agrees to the following:

• Provide all necessary materials (text, images, logos, credentials) in a timely manner.
• Respond to revision requests within a reasonable timeframe (typically 48 hours).
• Ensure all submitted content is legal and properly licensed.
• Review all deliverables before launch.

6. Intellectual Property Rights

Upon full payment:

• The client owns the final website design and custom code created for their project.
• I retain ownership of any pre-existing tools, frameworks, or proprietary components used during development.
• The client receives a license to use these components solely within the delivered website.
• I reserve the right to showcase the completed project in my portfolio and marketing materials.

7. Revisions and Changes

Each project includes a certain number of revisions as listed in the SOW. Additional revisions or major design/functionality changes will incur extra fees at a rate of $150/hr unless otherwise stated.

8. Warranties and Disclaimers

I warrant that all work will be delivered professionally and function as intended at the time of handoff. The following apply:

• Bugs caused by my code within 30 days of launch will be fixed at no charge.
• I do not guarantee specific SEO rankings, traffic increases, or sales outcomes.
• I am not responsible for issues caused by third-party services, hosting outages, or client modifications.
• I do not guarantee functionality beyond modern, supported browsers.

9. Limitation of Liability

A. Maximum Liability: My total liability for any claim will not exceed the amount paid for the specific project or service in question.

B. Disclaimer of Damages: I am not liable for loss of profits, data, revenue, or any indirect or consequential damages.

10. Termination

Either party may terminate the agreement in writing. Payment is due for all work completed up to the termination date. I may terminate immediately in cases of non-payment, abuse, or violations of these terms.

11. Confidentiality

Both parties agree to keep confidential information private. This obligation continues after the project is completed.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Texas. Both parties agree that any disputes will be handled exclusively in Harris County, Texas.

13. Changes to Terms

I may update these Terms at any time. Updates will be posted here, and continued use of my services means you accept the updated terms.
